CRITICAL LEGAL & SUCCESSION NOTICE
1. Not a Substitute for a Legal Will: Virasat is a record organization platform with server-encrypted vault content. Automated family handover is planned and currently unavailable. Virasat does not act as a law firm, wealth management fiduciary, or court of probate.
2. No Alteration of Statutory Heirship: Providing your bank details, insurance policies, or locker instructions to designated recipients via Virasat does not legally substitute for a formal registered Last Will and Testament, nor does it override statutory succession rights governed by the Indian Succession Act, 1925, the Hindu Succession Act, 1956, Muslim Personal Law (Shariat), or corresponding jurisdictional succession statutes.
3. Informational Roadmap: Virasat helps you organize references to your accounts and important documents. Users are encouraged to execute their formal legal testamentary instruments in accordance with local statutes.
1. Eligibility & Account Creation
To register an account on the Virasat mobile app or website, you must:
- Be at least 18 years of age or the age of majority in your jurisdiction.
- Possess the full legal capacity to enter into binding digital contracts.
- Provide accurate, genuine contact details for identity verification and safety check-ins.
- Maintain exclusive physical and biometric control over the mobile device running the application.
2. Server-Managed Encryption & Account Security
Virasat uses server-managed encryption for vault descriptions and uploaded files. You acknowledge the following technical realities:
- Server Encryption: Descriptions and files reach the API before AES-256-GCM encryption. Basic item metadata is stored separately.
- Key Custody: Virasat manages the server master key and authorized service processes can decrypt content. User-held encryption or recovery keys are not currently provided. Access depends on the supported account verification flow.
- Device Security: You are solely responsible for preventing unauthorized physical or biometric access to your smartphone.
3. Check-In Tools & Unavailable Release Features
Check-in tools record account activity. They do not establish health, authorize inheritance or provide an emergency response service. In the current release:
- Check-Ins: You may configure available schedule settings and confirm activity in the app.
- Notifications: Scheduled reminders, SMS, push delivery and vacation pause are not currently available.
- No Release Countdown: A missed check-in does not start an automatic 14-day or 30-day release workflow.
- Release Unavailable: Invitation delivery, recipient verification and access to released vault items are disabled while verified controls are developed.
- Independent Arrangements: Keep a separate estate plan, emergency contact process and copies of important records. Do not rely on Virasat for emergency delivery.
4. Nominees & Trusted Person Designations
When designating family members, spouses, children, or financial advisers as trusted recipients:
- You warrant that you have obtained their authorization to record their contact information on the platform.
- Virasat organizes the records you enter. It does not manage bank accounts, claim insurance proceeds, arbitrate inheritance disputes or currently deliver records to recipients.
- Saving a trusted person or intended assignment does not verify their identity or grant access to your vault.
5. Subscriptions, Founding Waitlist & Billing
Waitlist Registration
Waitlist signup is free and registers you for launch updates. Registration is confirmed only after the server acknowledges it. It does not activate a subscription, guarantee email delivery or confer a lifetime app entitlement.
Premium Tiers & In-App Purchases
App plans include Starter, Secure and Family, with different limits and feature availability. Check the app and supported store purchase flow for current prices and billing terms. Paid plans do not enable features that remain unavailable, including verified family handover and recipient access.
6. Acceptable Use & Prohibited Content
You agree not to use Virasat to store or transmit:
- Malicious code, spyware, or keyloggers.
- Stolen payment instruments or unauthorized credentials of third parties without consent.
- Child sexual abuse material (CSAM) or content violating Indian penal laws and international statutes.
- Any materials infringing third-party copyrights or intellectual property.
7. User Content Ownership & Intellectual Property
You retain 100% intellectual property ownership of all notes, letters, images, videos, and documents you upload to your Virasat vault. Virasat claims zero copyright, ownership, or licensing rights over your personal memories.
The Virasat trademark, brand identity, UI design, server encryption implementation, and source code are the exclusive property of Virasat Technologies Inc.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIRASAT TECHNOLOGIES INC. AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF BANK ASSETS, LOSS OF PROFITS, BANKING DISPUTES, SUCCESSION DISPUTES AMONG NOMINEES AND STATUTORY HEIRS, OR LOSS OF ACCESS TO STORED CONTENT. IN NO EVENT SHALL VIRASAT'S AGGREGATE LIABILITY EXCEED THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Governing Law, Arbitration & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to this contract shall be submitted to binding arbitration in New Delhi, India, conducted in English under the Arbitration and Conciliation Act, 1996. The courts of New Delhi, India shall have exclusive jurisdiction for interim relief and enforcement.
10. Account Deletion
You can permanently delete your account in the app under Profile → Delete Account. Deletion takes effect immediately and cannot be undone:
- Your account, vault items, uploaded files, trusted people and settings are removed from our servers.
- Files are encrypted with keys stored only alongside the deleted records, so remaining copies cannot be decrypted.
- Automated family handover is currently disabled. Keep independent copies of important content.
